Credit Cards & Online Payments  by 
We accept the following credit cards: Visa, MasterCard,  American Express and Discover. We also accept PayPal and Google Checkout as these are our preferred methods of payment. There is no surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your credit card will be billed upon shipment of your order.  If using Paypal or Google Checkout, you are required to submit payment as part of the checkout process. We will not ship any products before receiving payment and have the right to hold any shipment till payment has been confirmed.

Money Orders, Cashier’s Checks, Company Checks, & Personal Checks  by 
We accept money orders, cashier’s checks, personal checks, and company checks in U.S. Dollars only. Orders are processed upon receipt of your submitted payment if payment via these means. For personal and company checks, please allow up to 10 banking days after receipt for clearance of funds before the order is processed. We cannot accept out of state checks. We also cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks.

Multiple Product Orders  by 
For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order.

Order Acceptance Policy  by 
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Clark's reserves the right at any time after receipt of your order to accept or decline each order for any reason or to supply less than the quantity you ordered of any item. If after payment we cannot supply you with the entire amount that you ordered, we will then provide you with a refund in accordance with that amount.

Out-of-Stock Products  by 
We will ship your product as it becomes available. Usually, products ship the same day if ordered by 5:00PM EST, or by the next business day if your order is received after this time and for orders received on Saturday, Sunday or any major holiday. However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.

FOR TREATMENT · We may use health information about you to provide you with medical equipment, supplies, or prescriptions. We may disclose health information about you to doctors, therapists, technicians, office staff or other personnel who are involved in taking care of you and your health.

For example, information obtained by a respiratory therapist or other member of your healthcare team will be recorded in your record and used to determine the course of treatment that should work best for you. We may provide your physician or a subsequent healthcare provider with copies of various reports so they can help determine the most appropriate care for you.

Different personnel in our office may share information about you and disclose information to people who do not work in our office in order to coordinate your care, such as phoning in an order to a supplier for custom equipment. Family members and other health care providers may be part of your medical care outside this office and may require information about you that we have.

FOR PAYMENT · We may use and disclose health information about you so that the services you receive at this office may be billed to and payment may be collected from you, an insurance company or a third party such as a family member. For example, we may need to give your health plan information about a service you received here so your health plan will pay us or reimburse you for the service. We may contact your health insurer to certify that you are eligible for benefits (and for what range of benefits). We may also tell your health plan about a service you are going to receive to obtain prior approval, or to determine whether the plan will cover the treatment.

HEALTH CARE OPERATIONS · Our company may use and disclose your health information to operate our business. As examples of the ways in which we may use and disclose your information for our operations, our company may use your health information to evaluate the quality of care you received from us, or to conduct cost-management and business planning activities for our company.

TO AVERT A SERIOUS THREAT TO HEALTH OR SAFETY · We may use and disclose health information about you when necessary to prevent a serious threat to your health and safety or the health and safety of the public or another person.

REQUIRED BY LAW · We will disclose health information about you when required to do so by federal, state, or local law.

MILITARY, VETERANS, NATIONAL SECURITY AND INTELLIGENCE · Our company may disclose your health information if you are a member of U.S. or foreign military forces (including veterans) and if required by the appropriate military command authorities. Our company may also disclose your health information to federal officials for intelligence and national security activities authorized by law.

WORKERS COMPENSATION · Our company may release your health information for workers compensation or similar programs.

PUBLIC HEALTH RISKS · Our company may disclose your health information to public health authorities that are authorized by law to collect information for the purpose of:

  • Reporting abuse & neglect
  • Preventing or controlling disease, injury or disability
  • Notifying a person regarding potential exposure to a communicable disease
  • Notifying a person regarding a potential risk for spreading or contracting a disease or condition
  • Reporting reactions to drugs or problems with products or devices
  • Notifying individuals if a product or device they may be using has been recalled

HEALTH OVERSIGHT ACTIVITIES · Our company may disclose your health information to a health oversight agency for activities authorized by law. Oversight activities can include, for example, investigations, inspections, audits, surveys, licensure and disciplinary actions; civil, administrative, and criminal procedures or actions; or other activities necessary for the government to monitor government programs, compliance with civil rights laws and the health care system in general.

LAWSUITS AND DISPUTES · If you are involved in a lawsuit or a dispute, we may disclose health information about you in response to a court or administrative order.   Subject to all applicable legal requirements, we may also disclose health information about you in response to a subpoena.

LAW ENFORCEMENT · We may release health information if asked to do so by a law enforcement official in response to a court order, subpoena, warrant, summons or similar process, subject to all applicable legal requirements.

OTHER USES AND DISCLOSURES OF HEALTH INFORMATION · We will not use or disclose your health information for any purpose other than those identified in the previous sections without your specific, written
Authorization. If you give us
Authorization to use or disclose health information about you, you may revoke that
Authorization, in writing, at any time.   If you revoke your
Authorization, we will no longer use or disclose information about you for the reasons covered by your written
Authorization , but we cannot take back any uses or disclosures already made with your permission.


You have the following rights regarding health information we maintain about you:

RIGHT TO INSPECT AND COPY · You have the right to inspect and copy your health information, such as medical and billing records, that we use to make decisions about your care. You must submit a written request to our HIPAA Privacy Officer in order to inspect and/or copy your health information. If you request a copy of the information, we may charge a fee for the costs of copying, mailing or other associated supplies. We may deny your request to inspect and/or copy in certain limited circumstances. If you are denied access to your health information, you may ask that the denial be reviewed. If such a review is required by law, we will select a licensed health care professional to review your request and our denial. The person conducting the review will not be the person who denied your request, and we will comply with the outcome of the review.

RIGHT TO AMEND · If you believe health information we have about you is incorrect or incomplete, you may ask us to amend the information. You have the right to request an amendment as long as the information is kept by this office. To request an amendment, your request must be made in writing and submitted to our HIPAA Privacy Officer. You must provide us with a reason that supports your request for amendment. Our organization may deny your request if you ask us to amend information that is:

  • accurate and complete
  • not part of the identifiable health information kept by or for the company
  • not part of the identifiable information which you would be permitted to inspect and copy
  • not created by our company, unless the person or entity that created the information is not
  • available to amend the information

RIGHT TO AN ACCOUNTING OF DISCLOSURES · You have the right to request an “accounting of disclosures.”   This is a list of certain disclosures our organization has made of your identifiable health information. In order to obtain an accounting of disclosures, you must submit you request to our HIPAA privacy officer. It must state a time period, which may not be longer than six years and may not include dates before April 14, 2003.   The first list you request within a 12-month period is free of charge, but our company may charge you for additional lists within the same 12-month period. We will notify you of the costs involved with additional requests, and you may withdraw your request before you incur any costs.

RIGHT TO REQUEST RESTRICTIONS · You have the right to request a restriction in our use or disclosure of your health information for treatment, payment or health care operations. Additionally, you have the right to request that we limit our disclosure of your health information to individuals involved in your care or the payment for your care, such as your family members or friends.

We are not required to agree to your request; however, if we do agree, we are bound by our agreement except when otherwise required by law, in emergencies, or when the information is necessary to treat you. To request restrictions, you may complete and submit a Request For Restriction On Use/Disclosure Of Medical Information to our HIPAA Privacy Officer.

RIGHT TO REQUEST CONFIDENTIAL COMMUNICATIONS · You have the right to request that we communicate with you about medical matters in a certain way or at a certain location. For example, you can ask that we only contact you at work or by mail.   To request confidential communications, you may complete and submit the
Request For Restriction On Use/Disclosure Of Medical Information And/Or Confidential Communicationto our HIPAA privacy officer. We will not ask you the reason for your request. We will accommodate all reasonable requests.   Your request must specify how or where you wish to be contacted.

RIGHT TO A PAPER COPY OF THIS NOTICE · You are entitled to receive a paper copy of our Notice of Privacy Practices. You may ask us to give you a copy of this notice at any time. To obtain a paper copy of this notice, contact our HIPAA Privacy Officer at 937-428-7970.

RIGHT TO FILE A COMPLAINT · If you believe your privacy rights have been violated, you may file a complaint with our office or with the Office of Civil Rights. Returns  by 
Under what circumstances will you accept a return?
Return are accepted as within our 30 day grace period from date of sale. Fulfillment mistakes that we make resulting in the shipment of incorrect product to you will also be accepted for return 30 days from the date of purchase. If making an online purchase, you must notify us before returning as we must provide you with a RMA number. If purchased in store you must return to that location. Unless specifically noted there are no exceptions and exclusions apply as listed within this notice. See listing below for specific unreturnable products.
How many days does the customer have to return the items purchased?
We have a 30 day return policy from date of purchase. All items purchased online must be returned or shipped to the Centerville, OH store location. You must notify us within 30 days of sale if you intend to return any item. As long as you notify us within that time frame we will allow over 30 days as needed for processing and shipping. If making an in-store purchase that item must be returned to that individual location of purchase.
Does the item need to be return unworn, unused or in salable condition?
Yes, all items for return must be in unopened resellable condition. We have the right to deny your return if after we inspect the item it has been opened, used, damaged or otherwise unsellable. WE WILL NOT ACCEPT ANY RETURNS ON LIFT CHAIRS, SCOOTERS, BATH OR HYGEINE PRODUCTS. THIS ALSO INCLUDES JOBST MEDICAL LEGWEAR, FLA ORTHOPEDICS, & SPENCO FOOTWEAR PURCHASED ONLINE. Please make sure to measure before your purchase to ensure an accurate fit.
Will you accept a return if the item is damaged?
Yes, we will accept any returns due from shipping and manufacture defect. If your product arrives damaged we will offer a replacement if available or full refund of the product including shipping cost. You must contact us to advise of the issue before your return. If a manufactures issues a recall you may return the product to the store of purchase unless manufacture specifically requests sending directly to them for processing.
Does the customer need to include their receipt or  Proof of Purchase?
When making an in store purchase your original receipt is required for any refund, unless specifically advised otherwise. If purchase is done online, you may make a copy of your receipt and submit that copy with your return. Please include any sales order number if applicable that was identified off of your purchase.
Is the item returned for a credit or purchase other merchandise?
We will not issue a credit unless you specifically state you wish to keep a credit with our company or otherwise stated. If you do not have the original source of payment to return payment to, we may issue you a credit at our disgression. Any credit issued will not be more then what the intended refund amount would be. If credit is issued, there is no expiration date and there are no surcharges for such means of credit. Exchanging a product for a like item is not allowed unless we authorize beforehand and must follow all return guideliness set within this notice.
Is the item returned for full credit?
We will cover your return shipping charge if product is damaged through shipping or manufacture defect. Otherwise you are responsible to cover return shipping charges as they apply.
What is the restocking fee?
There is typically no restocking fees except for lift chairs and scooters which is 20% of the total purchase price. This only applies to those lift chairs and scooters that were paid for within the store. LIFT CHAIRS AND SCOOTERS SHIPPED ARE NOT RETURNABLE. If fee is applicable fee applies on all standard lift chairs and scooters. If a lift chair was custom ordered for you, meaning not a regually stocked item, we have the right to deny your return or charge additional fees as needed. We will notify you on any fees before you return your item, however you should check before making any return. As on all orders a full deposit is required before processing any order made online. You are required to bring back or ship to the store of purchase at your cost, unless due to manufacture defect. If you are unable to do so and live locally, we may at our discretion pickup your item, however additional charges may apply.
How do you process return payments?
We can only refund your payment as how it was purchased unless otherwise stated. If paying with credit card, we can only refund to that card to prevent fraudulant activities. Paypal payments will be returned via paypal. Please allow proper processing time for refund. Typically this takes 36-48hrs from date of processing your refund. If paying with money order, personal or company check, we will mail you a refund check to the billing address on record. Our refund checks are processed the first week of each month. This means it can take 2-3weeks to get your return check depending on the time of month your return was accepted. Obviously, we cannot accept cash payment for online orders. In store orders will be issued a cash refund if that was the payment type. If paying with check in store, then you may be issued a cash return if your purchase is under $200. For those orders over $200 a check must be issued which could delay processing time.

Shipping Policy  by 
Shipping Time -- Most orders received before 5:00PM EST will ship the same day, provided the product ordered is in stock. Most orders received after 5:00 PM EST will ship the next business day. Orders are not processed or shipped on Saturday or Sunday, except by prior arrangement.
We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by Clark's or other parties only as an estimate. If requesting overnight and other express shipping source, additional charges may apply and you will be made aware of those charges before shipment is made. As with any shipping method we cannot guarentee that your package will arrive within those time estimates. We encourage you to order in a timely fashion to avoid delays caused by shipping or product availability. If your package is lost by means of our shipping supplier, we will offer you an option of refund or reshipment of your order. Additional charges may apply depending on the circumstances.
Our standard shipping option is UPS Ground unless you otherwise request another method. We can also send out via United States Postal Service (USPS). Each carrier has its own restrictions in accordance to weight and size, therefore exclusions may apply when choosing a shipping carrier. Additional charges may apply if requesting quicker shipping or another service. It may be necessary to ship with another carrier if certain items are not in stock at our warehouse facilities. We will notify you as soon as possible if another carrier service is designated. Refund of difference will be applied if needed. Shipping charges shall be applied automatically and added upon checkout if you do not choose local pickup. If shipping is not added we will then follow up with you to advise of shipping before processing payment. If payment has already been processed by Paypal, Google Checkout, or other means, then will we advise of what shipping options you have and calculate pricing accordingly. If you request another delivery option, request quicker shipping or need to cancel an order please let us know as soon as possible.
Lift chairs, mobility scooters, other large items may be delivered via a freight courier given the weight and size of such items. It is our best intention to advise you of what service will be used when choosing these items and when delivery should be expected. Some items may be shipped directly from a manufacture as they will then provide courier information. It is each couriers policy to advise you ahead of time of such delivery although we can not guarentee this arrangement for every transaction.
Currently Clark's only ships products to those addresses within the continental United States. If you request an item be shipped to any other address, we will do our best to accommodate your needs however we cannot guarentee we will be able to process your order. Please nofify us with any questions you may have before placing your order.

Taxes  by 
Clark's will automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the state of OHIO and where required by law. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes as they apply.

Typographical Errors  by 
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Clark's shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card or other mean being charged. If payment has already been made for the purchase and your order is canceled, we will immediately issue a refund in the amount of the incorrect price to whateven means payment was made.
